นโยบายการประมวลผลข้อมูลส่วนบุคคลของลูกค้า

บริษัท ทีพลัส ครีเอชั่น จำกัด

มีจุดประสงค์แจ้งนโยบายข้อมูลส่วนบุคคลที่กำหนดเกี่ยวกับเงื่อนไขการเก็บและใช้ข้อมูลส่วนบุคคลของตัวแทนผู้ติดต่อของลูกค้านิติบุคคล (“ตัวแทนของลูกค้านิติบุคคล”) ที่ติดต่อเพื่อการใช้บริการสื่อสิ่งพิมพ์ของบริษัทเพื่อให้ลูกค้านิติบุคคลทราบเพื่อแจ้งให้ตัวแทนของลูกค้านิติบุคคลดังกล่าวรับทราบก่อนการส่งข้อมูลของตัวแทนของลูกค้านิติบุคคลนั้นเข้ามาในระบบของบริษัท

ทั้งนี้ เมื่อลูกค้านิติบุคคลตกลงใช้บริการสื่อสิ่งพิมพ์ (“บริการ”) จากบริษัทและแจ้งรายละเอียดของตัวแทนของลูกค้านิติบุคคลดังกล่าวให้แก่บริษัทแล้ว ทางบริษัทจะถือว่าลูกค้านิติบุคคลตกลงและยอมรับที่จะปฏิบัติตามนโยบายการประมวลผลข้อมูลส่วนบุคคลฉบับนี้แล้ว รวมถึงลูกค้านิติบุคคลนั้นจะถูกถือว่าให้การรับประกันเกี่ยวกับสิทธิของลูกค้านิติบุคคลในการแจ้งข้อมูลของตัวแทนของลูกค้านิติบุคคลดังกล่าวมายังบริษัทแล้ว

หากลูกค้านิติบุคคลไม่ตกลงให้บริษัทประมวลผลข้อมูลส่วนบุคคลของท่านตามที่ระบุไว้นี้ หรือลูกค้านิติบุคคลนั้นปฏิเสธการรับประกันสิทธิในการเปิดเผยข้อมูลของตัวแทนของลูกค้านิติบุคคลภายใต้เงื่อนไขที่ระบุไว้นี้ บริษัทสงวนสิทธิ์ที่จะปฏิเสธการให้บริการแก่ลูกค้านิติบุคคลนั้นเนื่องจากการประมวลผลข้อมูลส่วนบุคคลของตัวแทนของลูกค้านิติบุคคลภายใต้นโยบายฉบับนี้มีความจำเป็นอย่างยิ่งต่อการปฏิบัติหน้าที่ในการให้บริการของบริษัทให้แก่ลูกค้านิติบุคคล

ทางบริษัทอาจปรับปรุงนโยบายฉบับนี้ตามแต่ละระยะเวลาเพื่อให้สอดคล้องกับแนวปฏิบัติและกฎหมายที่เกี่ยวข้องและให้สอดคล้องกับการให้บริการต่างๆ ของบริษัท ทั้งนี้ บริษัทจะแจ้งให้ลูกค้านิติบุคคลและ/หรือตัวแทนของลูกค้านิติบุคคลทราบถึงการเปลี่ยนแปลงด้วยการประกาศนโยบายฉบับปรับปรุงใหม่ผ่านทางช่องทางการติดต่อของบริษัท

ข้อมูลส่วนบุคคลที่บริษัทประมวลผล

ทางบริษัทขอแจ้งให้ลูกค้านิติบุคคลทราบว่า การประมวลผลข้อมูลส่วนบุคคลที่ระบุไว้ภายใต้เงื่อนไขนโยบายข้อมูลส่วนบุคคลฉบับนี้มีความจำเป็นสำหรับการให้บริการของบริษัท ทั้งนี้ ข้อมูลส่วนบุคคลที่บริษัทมีความจำเป็นต้องประมวลผลข้อมูล มีดังนี้ (1) ข้อมูลการติดต่อของตัวแทนของลูกค้านิติบุคคล อาทิ ชื่อ นามสกุล ที่อยู่ เบอร์โทรศัพท์ หรือข้อมูลการติดต่ออื่นๆ เช่น Line ID / Facebook Account และ (2) ข้อมูลการเปิดบัญชีผู้ใช้งานของท่านในฐานะลูกค้านิติบุคคล ซึ่งอาจใช้ข้อมูลของตัวแทนของลูกค้านิติบุคคลเพื่อการลงทะเบียนการใช้บริการผ่านช่องทาง E-Commerce

จุดประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล

ข้อมูลส่วนบุคคลที่ท่านให้แก่บริษัทจะได้รับการเก็บและใช้เพื่อจุดประสงค์ดังต่อไปนี้

การดำเนินกระบวนการให้บริการสื่อสิ่งพิมพ์และการจัดส่งสื่อสิ่งพิมพ์ดังกล่าวให้แก่ท่าน ซึ่งรวมถึงการยืนยันคำสั่งซื้อสินค้า การยืนยันการชำระเงิน และการใช้ข้อมูลเพื่อติดต่อในการจัดส่งสินค้า
การสร้างและปรับปรุงความสัมพันธ์ทางธุรกิจที่บริษัทมีกับลูกค้านิติบุคคล ซึ่งอาจรวมถึงเพื่ออำนวยความสะดวกในการซื้อสินค้าของลูกค้านิติบุคคลในครั้งถัดไป การติดต่อไปสอบถามความพึงพอใจในการใช้บริการ การติดต่อสื่อสารตามเทศกาลต่างๆ การติดต่อไปนำเสนอสินค้าและบริการที่อาจเกี่ยวเนื่องแก่ลูกค้านิติบุคคลดังกล่าว หรือการติดต่อทางธุรกิจในรูปแบบอื่นตามที่เหมาะสม โดยบริษัทรับประกันจะดำเนินการดังกล่าวภายใต้กรอบที่จะไม่กระทบสิทธิของตัวแทนของลูกค้านิติบุคคลนั้นมากจนเกินควร
การจัดการตอบรับการสื่อสารที่ท่านติดต่อทางบริษัท (เช่น เพื่อการติดต่อกลับในการเสนอราคาและการ ให้บริการในกรณีจำเป็นอื่นๆ หรือเพื่อการตอบคำถามหรือการจัดการข้อร้องเรียนหรือการให้ความคิดเห็นต่างๆ)
การปฏิบัติหน้าที่ตามกฎหมายที่บริษัทอาจต้องปฏิบัติตาม เช่น หน้าที่ในการจัดทำบัญชีและชำระภาษีซึ่งในกรณีการประมวลผลข้อมูลเพื่อประโยชน์ในการปฏิบัติตามหน้าที่ในกฎหมายนี้ บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลเท่าที่จำเป็นสำหรับการปฏิบัติหน้าที่ดังกล่าวไว้ตามกรอบระยะเวลาที่กฎหมายกำหนดไว้
กรณีที่ท่านลูกค้านิติบุคคลและ/หรือตัวแทนของลูกค้านิติบุคคลให้การยินยอมเป็นกรณีเฉพาะ บริษัทจะใช้ข้อมูลการติดต่อของตัวแทนของลูกค้านิติบุคคลในการติดต่อประชาสัมพันธ์ข่าวสารต่างๆ ที่ลูกค้านิติบุคคลอาจสนใจ

บริษัทมีความจำเป็นต้องประมวลผลและเก็บรวบรวมข้อมูลส่วนบุคคลของตัวแทนของลูกค้านิติบุคคล เพื่อจุดประสงค์ต่างๆ ที่ระบุไว้ข้างต้นตลอดระยะเวลาตราบเท่าที่บริษัทยังมีหน้าที่ตามสัญญาการให้บริการแก่ท่าน นอกจากนี้บริษัทสงวนสิทธิ์เก็บข้อมูลส่วนบุคคลของตัวแทนของลูกค้านิติบุคคลเพื่อประโยชน์ในการติดต่อนิติบุคคลของท่านไว้ตลอดระยะเวลาที่จะเป็นเพื่อการสร้างความสัมพันธ์ทางธุรกิจของท่าน และกรณีได้รับความยินยอม บริษัทจะเก็บและใช้ข้อมูลส่วนบุคคลของตัวแทนของลูกค้านิติบุคคล จนกว่าท่านจะถอนความยินยอม

การเปิดเผยข้อมูลส่วนบุคคล

โดยหลัก ข้อมูลส่วนบุคคลของตัวแทนของลูกค้านิติบุคคลที่บริษัทได้รับจะได้รับการเก็บเป็นความลับ แต่บริษัทอาจมีความจำเป็นต้องเปิดเผยและส่งต่อข้อมูลส่วนบุคคลของท่านให้แก่ (i) ผู้ให้บริการภายนอกที่ให้บริการแก่ทางบริษัทโดยเฉพาะผู้ให้บริการจัดส่งและขนส่งสินค้าจากบริษัทให้แก่ท่าน (ii) ในกรณีมีความจำเป็นที่บริษัทต้องใช้สิทธิในการปกป้องสิทธิอันชอบธรรมของบริษัท บริษัทอาจมีความจำเป็นเปิดเผยข้อมูลให้แก่ที่ปรึกษาของบริษัท เช่น ที่ปรึกษากฎหมายหรือทนายความ เป็นต้น และ (iii) บริษัทอาจมีความจำเป็นต้องเปิดเผยข้อมูลส่วนบุคคลของผู้ใช้บริการให้แก่หน่วยงานราชการต่างๆ เพื่อการปฏิบัติตามหน้าที่ที่มีตามกฎหมาย ทั้งนี้ ในการเปิดเผยข้อมูลดังกล่าวทั้งหมด บริษัทจะดำเนินการเพียงเท่าที่จำเป็นตามหน้าที่ดังกล่าวเท่านั้น

คำรับประกันการดำเนินมาตรการรักษาความมั่นคงปลอดภัยในข้อมูลที่เหมาะสม

บริษัทรับประกันจัดให้มีมาตรการการรักษาความมั่นคงปลอดภัยที่เหมาะสมเพื่อป้องกันการเข้าถึง การใช้ การเปลี่ยนแปลง การแก้ไข หรือการเปิดเผยข้อมูลส่วนบุคคลทั้งหมดที่บริษัทได้รับ โดยปราศจากอำนาจหรือโดยมิชอบ โดยบริษัทจะจัดให้มีการทบทวนมาตรการดังกล่าวเป็นระยะเพื่อความเหมาะสมตามมาตรฐานในอุตสาหกรรมและโดยสอดคล้องกับกฎหมายที่เกี่ยวข้อง

สิทธิของเจ้าของข้อมูล

บริษัทเคารพสิทธิตามกฎหมายของลูกค้านิติบุคคล และโดยเฉพาะสิทธิของตัวแทนของลูกค้านิติบุคคลในฐานะเจ้าของข้อมูลในส่วนที่เกี่ยวข้องกับข้อมูลส่วนบุคคลของท่านที่อยู่ในการควบคุมของบริษัท โดยเจ้าของข้อมูลเหล่านั้นสามารถขอใช้สิทธิที่ท่านมีได้ตามเงื่อนไขกำหนดสิทธิที่ระบุไว้ในกฎหมาย ได้แก่

สิทธิขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคล รวมถึงสิทธิในการขอแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง
สิทธิขอรับข้อมูลส่วนบุคคล ในกรณีที่บริษัททำให้ข้อมูลส่วนบุคคลนั้นอยู่ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติ รวมถึงสิทธิขอให้ส่งหรือโอนข้อมูลรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่น
สิทธิคัดค้านการประมวลผลข้อมูลส่วนบุคคล
สิทธิขอให้ลบหรือทำลายหรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ เมื่อข้อมูลนั้นหมดความจำเป็น
สิทธิในการขอให้ระงับการใช้ข้อมูลส่วนบุคคลได้ หรือ
สิทธิถอนความยินยอมในการประมวลผลข้อมูลที่เจ้าของข้อมูลเคยให้ไว้ตามวัตถุประสงค์ที่ระบุไว้

ทั้งนี้ ท่านสามารถติดต่อมายังบริษัทเพื่อดำเนินการขอใช้สิทธิข้างต้นได้ ตามรายละเอียดการติดต่อที่บริษัทแจ้งไว้ โดยบริษัทจะแจ้งผลการพิจารณาคำร้องของท่านให้ทราบภายใน 30 วันนับแต่วันที่ได้รับคำร้องขอดังกล่าว

Customer Privacy Notice

T-Plus Creation Company Limited

T-Plus Creation Company Limited (the “Company”) intends to announce this Customer Privacy Notice defining the terms and conditions and details for the process of personal data of the representative / focal persons of the corporate customer (the “Customer’s Representative”) that contacts the Company for the publishing services to inform the relevant Customer’s Representative before they will submit any information to the Company.

Once any customer agrees to use the publish services (the “Services”) from the Company and notify the information of the relevant Customer’s Representative to the Company, the Company shall deem that such customer agree and accept to be bound by this Privacy Notice and the relevant customer shall be deemed of giving representation on the legitimate rights of the relevant customer to inform and submit the Customer’s Representative to the Company.

In case that any customer do not accept to this Privacy Notice or reject to give representative to their legitimate rights in disclosing the Customer’s Representative to the Company, the Company reserves the right to reject to provide relevant Services to the customer since the process of those personal data of the Customer’s Representative is essential for the performance of the obligations that the Company has with the relevant customer.

The Company may make any revisions to this Privacy Notice from time to time in order to assure the compliance of this Privacy Notice with the relevant laws and the adjusted scope of business that the Company may have; provided that the Company will notify the relevant customer of those changes made through the communication channel that the Company has with the relevant customer.

Personal Data being Processed

The Company would like to emphasize to the relevant customer that the process of the personal data as defined under this Privacy Notice is important to the performance of any services by the Company to the customer.

The personal data required to be processed hereunder include: (1) contact information of the Customer’s Representative, including full name, address, telephone number or other contact information (i.e. Line ID / Facebook Account); and (2) E-Commerce user account registration information of the relevant customer that would include the personal data of the Customer’s Representative.

Purposes of the Personal Data Processing

Personal data being collected shall be used and processed for the following purposes:

Processed during the performance of the publishing and delivery services of the relevant products and Services to the customer, including the process of the personal data in the process of the Services confirmation, payment confirmation and delivery services of the finished products;
Processed for the purpose of the business relationship improvement and adjustment between the Company and the Customer, including without limitation to facilitate the next order made by the relevant customer; to ask for the satisfaction feedback from the customer; to contact and communication in the normal traditional occasion; to recommend the products and Services that may relate to the relevant customer; or to process for other type of business communication between the Company and the customer. For all of these processes, the Company undertake to only process the personal data that will not excessively violate or cause impact to the rights of the relevant Customer’s Representative as the data subject;
Processed for the purpose of the communication management between the Company and the relevant customer, including to propose the relevant quotation of the relevant Services that the customer may request for and to respond to relevant queries or complaints made by the Customer;
Processed for the purpose of the legal obligation performance by the Company, including, taxes and accounting obligations under the relevant laws; provided that for this purpose, the Company would need to process the personal data for the period of time as prescribed under the relevant laws; and
With the specific consent given by the customer and/or Customer’s Representative, processed for the marketing purposes.

The Company would need to process and retain all of these personal data of the Customer’s Representative for the defined purposes throughout the period of time that the Company may have the contractual obligation to perform to the relevant customer and the Company would need to reserve the personal data of the Customer’s Representative for the contact throughout the time that the Company may still have the business relationship with the customer. Also, in case of any process undertaken in reliance to the consent, the Company would retain such personal data until the consent is withdrawn.

Disclosure of the Personal Data

Generally, the personal data of the Customer’s Representative will be kept confidential; provided that in certain circumstances the personal data of the Customer’s Representative may need to be disclosed to the following persons: (i) to the third party service provider of the Company, in particular the logistic and delivery service providers; (ii) to the legal counsel or litigator in case that the Company would need protect their legitimate rights in any dispute or claim raised; and (iii) to the government authorities that the Company may be obliged under the relevant laws to disclose the personal data to those authorities; provided that in all of these circumstances, the Company will only disclose the personal data to the necessary extent to perform those obligations or to serve the defined objectives.

Representation on the Information Security of the Personal Data

The Company represent to implement the reasonable and appropriate information security measures of all personal data being processed in order to prevent the unauthorized access, amendment or disclosure of those information; provided that the Company commits to review those measures from time to time to ensure the compliance with the relevant industry practice and relevant legal framework.

Data Subject Rights

The Company respects the following rights relating to the personal data of the customer, in particular the Customer’s Representative as the data subject that relates to the personal data being processed or controlled by the Company and the Company acknowledges that the data subject may exercise the following rights as defined under the relevant laws:

Right to access; to request for the copy; and to rectify or update their own PII
Right to request for data portability of the PII that the Company has processed in the readable forms by the tools or automatic mechanics to other data controller;
Right to object to the PII process being undertaken;
Right to request for the erasure or de-identification of any PII that does not have any necessary basis to process or after the consent withdrawal;
Right to request for the suspension of PII process in case that request for erasure is being exercised or when it is unnecessary to process such PII;
Right to withdraw consent that has been given.

Please feel free to contact the Company in case any data subject rights would be exercised and the Company will get back to you with the response to your rights requested within 30 days after the receipt of such request.
